Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and NyxSaga ("NyxSaga," "we," "us," or "our") for your use of the NyxSaga website, apps, and related services (the "Service").

By accessing or using the Service, creating an account, purchasing coins, or applying as a creator, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use the Service with permission and supervision of a parent or legal guardian who accepts these Terms on your behalf.

Creator accounts and payout features require you to be at least 18 years old (or the age of majority in your country), as described in our Creator Program.

You may not use the Service if you are barred from doing so under applicable law, if we have suspended or closed your account, or if using randomized digital collectibles is prohibited where you live.

You are responsible for the activity that happens under your account. Keep your password confidential and tell us promptly at support@nyxsaga.com if you believe your account was accessed without permission.

You agree to provide accurate registration information and to update it when it changes. Impersonation, shared accounts used to evade bans, and automated account creation are not allowed.

We may suspend or terminate accounts that violate these Terms, harm other users, or create legal or security risk for the platform.

NyxSaga offers digital nyx cards, nyx saga packs, coins, stars, and related virtual items (together, "Virtual Items"). Virtual Items are licensed for your personal, non-commercial use inside the Service unless we say otherwise.

Unless required by law or explicitly stated in a separate refund policy, all purchases of coins and Virtual Items are final. Virtual Items have no real-world cash value outside the Service and cannot be exchanged for money from NyxSaga except where a creator payout program explicitly applies to eligible creator earnings.

We may change, rebalance, retire, or remove Virtual Items, packs, odds displays, or economy features to keep the Service fair, lawful, and sustainable. We will use reasonable efforts to avoid unfairly wiping paid progress, but we do not guarantee that any Virtual Item will remain available forever.

Opening a nyx saga pack ("pull") uses coins or promotional grants and reveals one nyx card according to the published odds for that pack. Results are randomized. You may receive duplicates.

Displayed odds, rarities, and pity rules are part of the pack information we provide at the time of the pull. We work to keep this information accurate, but technical errors may occur. If we confirm a material error, we may correct it and, where appropriate, offer a remedy at our discretion.

Free daily rolls, promotional grants, and test environments may use separate rules. Only paid coin pulls and eligible star claims count toward creator earnings as described in the Creator Program.

The Service is a digital collectible experience, not gambling. You are responsible for complying with local laws that may restrict paid random digital items.

Coin purchases and other paid features may be processed by third-party payment providers such as Stripe. Their terms and privacy practices also apply to payment processing.

You authorize us and our payment partners to charge your selected payment method for purchases you make. Prices, bundles, and taxes may change with notice where required.

Except where mandatory consumer laws apply, coin purchases are non-refundable once delivered. If you believe a charge was made in error, contact support@nyxsaga.com before initiating a chargeback. Abuse of refunds or chargebacks may result in suspension and reversal of Virtual Items.

Creators who publish Nyx Saga Packs must apply, be approved, and follow the Creator Program requirements published at /creators. Those requirements are incorporated into these Terms by reference.

Creators represent that they own or have permission to use all art, names, characters, and other materials in their packs. Creators grant NyxSaga a worldwide, non-exclusive license to host, display, distribute, and promote that content within the Service.

Creator earnings, holds, minimum payouts, and tax responsibilities are described in the Creator Program and Studio tools. NyxSaga may withhold or reverse payouts for fraud, chargebacks, policy violations, or legal compliance.

You agree not to:

You retain ownership of content you submit, such as profile information, creator artwork, and pack metadata ("User Content"). You grant NyxSaga a worldwide, royalty-free, sublicensable license to use, host, reproduce, adapt, publish, and display User Content solely to operate, improve, and promote the Service.

You are solely responsible for User Content you submit and for obtaining any permissions needed for it. We may remove or restrict content that violates these Terms or that we reasonably believe creates risk for users or the platform.

If you send suggestions or feedback, you grant us the right to use it without restriction or compensation.

The Service, including its software, design, logos, and original platform content (excluding User Content), is owned by NyxSaga or its licensors and is protected by intellectual property laws.

We grant you a limited, revocable, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly allowed.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, email legal@nyxsaga.com with: (1) your contact information; (2) identification of the copyrighted work; (3) the URL or description of the infringing material; (4) a statement of good-faith belief; and (5) a statement, under penalty of perjury where applicable, that your notice is accurate and you are authorized to act.

We may remove reported content and terminate repeat infringers when appropriate.

We may investigate violations, cooperate with law enforcement, and take action including warnings, content removal, pack takedowns, payout holds, and account suspension or termination.

We are not obligated to monitor all content or activity. We do not guarantee that harmful or unlawful material will never appear on the Service.

If your account is restricted, you may contact support@nyxsaga.com. Some decisions are final when required for safety, legal compliance, or repeated abuse.

THE SERVICE AND ALL VIRTUAL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that pulls, odds displays, payouts, cloud sync, or any feature will be uninterrupted, secure, or error-free, or that defects will be corrected.

Your use of the Service is at your own risk. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

To the fullest extent permitted by law, NyxSaga and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or Virtual Items, arising from your use of the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service or these Terms is limited to the greater of (a) the amount you paid to NyxSaga in the 12 months before the event giving rise to the claim, or (b) USD $50.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or intentional misconduct.

You will defend, indemnify, and hold harmless NyxSaga and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

You may stop using the Service at any time. We may suspend or terminate your access immediately if you violate these Terms, create risk, or if we discontinue the Service or a feature.

Upon termination, your license to use the Service ends. We may delete or deactivate account data as described in our Privacy Policy. Sections that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

We may update these Terms from time to time. When we make material changes, we will post the updated Terms with a new effective date and, where appropriate, provide additional notice in the Service or by email.

Your continued use after the effective date of updated Terms constitutes acceptance. If you do not agree, stop using the Service before the changes take effect.

These Terms are governed by the laws applicable to NyxSaga's place of business, excluding conflict-of-law principles, except where mandatory consumer protection laws in your country require otherwise.

Before filing a formal claim, you agree to contact us at legal@nyxsaga.com and try to resolve the dispute informally within 30 days.

Where permitted by law, you and NyxSaga agree that disputes will be brought in the courts located where NyxSaga operates, unless mandatory law gives you the right to bring claims in your home country.
